Derechos de las mujeres en el sector agrario

La migración a los centros urbanos ha dado lugar a un rápido aumento en el número de familias rurales cuyo jefe de hogar es una mujer, muchas de estas mujeres son también las que gozan de menor poder social, es decir, madres solteras, viudas, divorciadas, esposas de trabajadores migrantes, ancianas y enfermas que en general carecen de la posibilidad para tomar decisiones, pues muchas veces no tienen representación en el gobierno de la comunidad y cada vez tienen menos seguridad individual en la legislación.

En la mayor parte de las sociedades, las mujeres no tienen igualdad de acceso a la tierra rural ni a los correspondientes recursos naturales y muchas veces el cambio de la situación socioeconómica hace que las antiguas normas no puedan garantizar que la mujer tenga acceso a los recursos necesarios.

Esto da paso a que se generen varios intentos por reafirmar sus derechos lo cual muchas veces llega a desencadenar conflictos en la comunidad, pues se presenta con mucha frecuencia que los derechos que tienen las mujeres son sometidos por los varones de la comunidad.

Esto representa un gran problema ya que tan solo las mujeres campesinas generan la mitad de la producción alimentaria mundial, llegando a producir entre el 60 y el 80 por ciento de los alimentos en la mayor parte de los países en desarrollo, encargándose también de las actividades de almacenamiento, manipulación, comercialización y elaboración de los productos, todo esto sin tener una seguridad sobre la tenencia de la tierra, y mediante la reforma agraria y los proyectos de titulación y registro, muchas veces no se han llegado a reconocer los derechos de la mujer, pues en estos proyectos se consideraba suficiente la intervención de los varones, que solían recibir los títulos de propiedad, dándose por sentado que las mujeres y los niños se beneficiarían al considerar que son dependientes de aquellos.

Al respecto, el Instituto Nacional de Antropología e Historia (INAH), el Tribunal Unitario Agrario (TUA) y el Registro Agrario Nacional (RAN) dialogaron en su conferencia “Tierra de mujeres” sobre los obstáculos y desafíos que enfrentan las mujeres que trabajan en el campo mexicano, pues como ya se expuso en párrafos anteriores, a pesar de que las agricultoras producen la mitad de los alimentos, de cada 10 personas con derechos sobre la tierra, únicamente tres son mujeres.

Otro punto importante que señaló la Doctora Guadalupe Isela Chávez Cardoso, Presidenta del Instituto de la Mujer para el estado de Morelos es que, al no ser propietarias de la tierra, las mujeres tampoco pueden recibir apoyos de programas de equipamiento, de infraestructura, créditos o apoyos económicos por pago de servicios ambientales.

Esto puede deberse a que el trabajo que realizan las mujeres se le considera como “una ayuda” y no realmente como un trabajo productivo, lo cual conlleva a que no se les reconozca como actoras productivas, si no como ayudantes.

Un ejemplo claro de esto es que apenas hace un año que se reformaron los artículos 17 y 18 de la ley agraria donde ahora se les da a las mujeres la posibilidad de ser sucesoras, siendo que antes no podían y no puede ser posible que a estas alturas apenas hayan reformado dichos artículos.

Es necesario que las autoridades atiendan a este sector de la población, pues se debe comenzar a combatir el machismo que se llega a presentar en el medio rural para que las mujeres que se encuentran en ese entorno tengan igualdad de acceso a la tierra, alimentación, producción, salud y cultura.

Por otra parte, si bien las reformas son un avance, esto no es suficiente pues también se requieren cambios en las prácticas culturales, de nada sirve que las leyes de un país declaren que el hombre y la mujer tienen igualdad de derechos, si las prácticas culturales están en contradicción con esas leyes y no se les presta atención.

Las reformas en las leyes, los cambios en las prácticas culturales y la elaboración de programas de divulgación como por ejemplo las iniciativas de educación e información que permitan a las mujeres conocer sus derechos sobre la tierra, pueden generar grandes cambios para evitar que se sigan violentando sus derechos.
